Welcome to Luxpixia. Luxpixia is operated by Digital Galleria Designs, LTD. By accessing our website, using our gallery platform, placing orders, booking services, downloading images, or otherwise interacting with Luxpixia, you agree to the following Terms of Use.
These Terms apply to website usage, photography services, online galleries, digital downloads, print orders, school photography, sports photography, event photography, and related services provided by Luxpixia.
Copyright & Image Ownership
All photographs, images, graphics, designs, previews, galleries, and related content created by Luxpixia remain the copyrighted property of Luxpixia unless otherwise stated in writing.
Purchasing prints, products, or digital downloads does not transfer copyright ownership.
Purchased digital downloads include a limited personal-use print release for the purchaser only. Commercial use, resale, redistribution, publication, contest entry, advertising use, business use, or other unauthorized reproduction is prohibited without written permission from Luxpixia.
Gallery previews, screenshots, screen recordings, social media captures, watermarked images, or unauthorized downloads may not be copied, reproduced, printed, edited, distributed, or used in place of purchased products or digital downloads.
Artificial Intelligence, Editing & Alteration Restrictions
Photographs, gallery images, previews, and digital files may not be scraped, copied, downloaded, archived, reproduced, used for artificial intelligence training, machine learning datasets, facial recognition systems, or redistributed without written permission from Luxpixia.
Purchased images may not be substantially altered, edited, filtered, manipulated, enhanced through artificial intelligence tools, or otherwise modified in a manner that misrepresents the original work created by Luxpixia.
Removal of watermarks, logos, copyright notices, or branding is prohibited.
Minor cropping for personal social media formatting is permitted so long as the integrity of the image is reasonably maintained.
Gallery Access & Privacy
Schools, organizations, parents, and clients are responsible for providing accurate and authorized email addresses and contact information for gallery access and communications.
For privacy and security reasons, Luxpixia will not add new individuals, email addresses, or recipients to gallery access requests solely through customer service inquiries. Corrections of typographical errors or minor email address mistakes may be permitted when reasonably verified. Additional or updated gallery access requests may require authorization through the original school, organization, or authorized account holder.
Schools, organizations, teams, or authorized contacts may distribute gallery access information, ordering information, or gallery links to parents, students, participants, or related individuals.
Luxpixia is not responsible for unauthorized forwarding, sharing, reposting, downloading, screenshots, or redistribution of gallery access links, images, or ordering information by third parties after authorized delivery or distribution has occurred. Attempting to access galleries, accounts, images, downloads, or ordering information without authorization is prohibited. Clients, schools, organizations, and users submitting images, information, or content to Luxpixia represent that they have the necessary rights, permissions, and authority to provide such materials.
Orders, Products & Digital Downloads
All digital download sales are final.
Because many products are custom, personalized, or produced specifically for each order, cancellations, refunds, or changes may not be possible once production has begun.
Luxpixia is committed to exceptional customer service and customer satisfaction. If concerns arise involving verified production issues, print defects, fulfillment errors, or studio-related mistakes, clients are encouraged to contact Luxpixia promptly so reasonable solutions may be considered.
Clients are responsible for reviewing spelling, personalization information, shipping information, and order details before submitting orders. Luxpixia is not responsible for customer-submitted errors.
Clients are responsible for downloading and backing up purchased digital files after delivery. Luxpixia is not responsible for loss of files resulting from expired galleries, deleted emails, customer device failures, lost downloads, accidental deletion, or circumstances outside of Luxpixia’s reasonable control.
Gallery Availability & Pricing
Online galleries are generally available for at least one year from the original delivery date unless otherwise stated. Availability beyond that timeframe is not guaranteed. Luxpixia reserves the right to archive, remove, or delete galleries, files, digital downloads, or related content after stated availability periods.
Pricing, promotions, product availability, shipping options, and ordering terms may change after six months from the original gallery delivery date.
Printing & Color Variations
Luxpixia carefully calibrates and prepares images for professional-quality printing and products through our recommended workflows and print providers.
Because outside printers, screens, papers, inks, finishes, lighting conditions, and equipment vary significantly, Luxpixia cannot guarantee color accuracy, brightness, cropping, or print quality from third-party vendors.
Clients using outside printing services are encouraged to order test prints before placing large orders.
Luxpixia is not responsible for print quality, color accuracy, cropping, or production results from unauthorized third-party printing vendors or from images obtained through screenshots, social media downloads, or unauthorized reproductions.
Artistic Discretion
Luxpixia retains full creative and artistic discretion regarding photography style, posing, composition, lighting, editing, retouching, image selection, and final delivered content.
Due to the nature of live events, school photography, sports photography, children, individualized sessions, and event conditions, Luxpixia does not guarantee every requested pose, expression, image, moment, or composition.
Clients acknowledge that photographic work is subjective and based on Luxpixia’s artistic judgment and professional workflow.
Scheduling, Delays & Force Majeure
Luxpixia reserves the right to reasonably reschedule, modify, postpone, or cancel photography services due to weather, illness, emergencies, equipment failure, unsafe conditions, venue restrictions, scheduling conflicts, acts of nature, shipping disruptions, school scheduling changes, or circumstances outside of Luxpixia’s reasonable control.
Reasonable efforts will be made to accommodate rescheduling when possible.
Any estimated turnaround times, delivery dates, or production timelines provided by Luxpixia are estimates only and are not guaranteed unless specifically confirmed in writing.
Delivery timelines may vary due to seasonal volume, event schedules, editing workload, lab production times, shipping delays, technical issues, or circumstances outside of Luxpixia’s reasonable control. Certain services may rely on trusted third-party providers, platforms, labs, hosting services, software systems, payment processors, shipping carriers, or communication systems. Luxpixia is not responsible for outages, interruptions, security incidents, delays, or technical failures originating from third-party systems outside of Luxpixia’s reasonable control.
Refusal of Service
Luxpixia reserves the right to refuse service, cancel orders, suspend gallery access, remove content, or terminate services at its discretion in situations involving unpaid balances, chargebacks, suspected fraud, abuse, harassment, unauthorized image use, policy violations, security concerns, or other inappropriate conduct.
Governing Law
These Terms shall be governed and interpreted under the laws of the State of Iowa. Any disputes arising under these Terms shall be handled in the appropriate courts located within the State of Iowa.
Changes to These Terms
Luxpixia may update or modify these Terms of Use at any time. Updated versions will be posted with a revised effective date.
